1.0 DEFINITIONS
- Property Owner: The individual or entity that owns the furnished apartment listed on our platform.
- Guest: The individual making the booking and occupying the property.
- Premises: The furnished apartment being booked.
- Platform: Our property booking website and related services.
- Booking Period: The duration for which the property is reserved.
2.0 NATURE OF AGREEMENT
- All bookings create a license agreement, not a tenancy.
- Guests have no security of tenure or statutory protection under tenancy legislation.
- Property Owners retain control and possession of the Premises.
- Guests do not have exclusive possession rights.
3.0 BOOKING AND PAYMENT
3.1 Booking Process
- All bookings must be made through our Platform.
- Bookings are subject to availability and Property Owner approval.
- You must provide accurate personal and payment information.
- You must be at least 18 years old to make a booking.
3.2 Payment Terms
- Full payment or deposit (as specified) is required to confirm your booking.
- Payment can be made via credit card, debit card, bank transfer, or other methods accepted on our Platform.
- All fees are non-refundable except as provided in our Cancellation Policy.
- Prices are displayed in Nigerian Naira (NGN) unless otherwise stated.
3.3 Security Deposit
- A refundable security deposit may be required as specified in the property listing.
- The security deposit will be refunded within 7-14 days after checkout, subject to deductions for damages, missing items, or unpaid charges.
- Property Owners will provide an itemized statement for any deductions.
4.0 CANCELLATION POLICY
- By Guest: Cancellation terms vary by property. Please review the specific cancellation policy displayed on each property listing before booking.
- By Property Owner: In rare circumstances, a Property Owner may cancel a confirmed booking. In such cases, you will receive a full refund and assistance in finding alternative accommodation.
- Cancellation requests must be submitted through our Platform.
- No-shows are subject to full charges without refund.
5.0 CHECK-IN AND CHECK-OUT
- Check-in and check-out times are specified in your booking confirmation.
- Early check-in or late check-out may be available for an additional fee, subject to Property Owner approval.
- You must present valid identification upon check-in.
- You will receive keys or access codes as specified by the Property Owner.
- All keys and access devices must be returned upon checkout.
6.0 GUEST RESPONSIBILITIES
6.1 Use of Premises
- Use the property in a responsible and respectful manner.
- Comply with all applicable laws and regulations.
- Do not exceed the maximum occupancy stated in the listing.
- Do not use the property for illegal, immoral, or commercial purposes without prior written consent.
- Do not sublet or assign your booking to any third party.
6.2 Property Care
- Maintain the property in good condition throughout your stay.
- Report any damage or maintenance issues immediately through our Platform.
- You are responsible for any damage beyond normal wear and tear.
- Do not make any alterations to the property.
- Leave the property clean and tidy upon departure.
6.3 Noise and Disturbances
- Respect neighbors and observe quiet hours (typically 10:00 PM – 7:00 AM).
- Do not engage in activities that cause excessive noise or disturbances.
- Parties or events are not permitted unless explicitly authorized by the Property Owner.
6.4 Pets and Smoking
- Pets are not allowed unless the property is specifically designated as pet-friendly.
- Smoking is prohibited inside all properties unless otherwise stated.
- Violations may result in additional cleaning fees and forfeiture of your security deposit.
7.0 PROPERTY OWNER RIGHTS
- Property Owners reserve the right to access the property with reasonable notice for inspections, maintenance, or emergencies.
- Property Owners may enter without notice in case of emergency.
- Property Owners may terminate your stay immediately for breach of these terms, illegal activities, or causing significant damage.
8.0 UTILITIES AND SERVICES
- Utilities included in the booking fee are specified in each property listing.
- Some utilities may be charged separately based on usage.
- Internet, electricity, and water services are provided subject to local availability and may be subject to interruptions beyond our control.
9.0 INVENTORY AND FURNISHINGS
- An inventory of furnishings and equipment is available upon request.
- You are responsible for all items listed in the inventory.
- Missing or damaged items will be charged to your security deposit or payment method on file.
- Report any discrepancies in the inventory within 24 hours of check-in.
10.0 INSURANCE AND LIABILITY
- Property Owners maintain building insurance for the properties.
- We strongly recommend that Guests obtain travel and contents insurance for personal belongings.
- Neither the Platform nor Property Owners are liable for loss, theft, or damage to your personal property.
- You are liable for any injuries or damages caused by your negligence or misconduct.
11.0 FORCE MAJEURE
- Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including:
- Acts of God, natural disasters, pandemics, epidemics
- War, terrorism, civil unrest, strikes
- Government actions, travel restrictions, lockdowns
- Utility failures, infrastructure breakdowns
- In such events, we will work with you to find a suitable solution, which may include rescheduling or refunds at our discretion.
12.0 MODIFICATIONS AND AMENDMENTS
- Changes to confirmed bookings are subject to availability and may incur additional fees.
- All modification requests must be made through our Platform.
- We reserve the right to modify these Terms and Conditions at any time. Your continued use of our Platform constitutes acceptance of any changes.
13.0 DISPUTE RESOLUTION
- Any disputes should first be reported through our Platform’s resolution centre.
- We will facilitate good faith negotiations between you and the Property Owner.
- If resolution cannot be reached, disputes may be submitted to mediation.
- Legal proceedings may be commenced in the courts of Lagos State, Nigeria.
14.0 PRIVACY AND DATA PROTECTION
- Your personal information is collected and processed in accordance with our Privacy Policy.
- By making a booking, you consent to the collection and use of your information as described in our Privacy Policy.
- We may share your information with Property Owners as necessary to facilitate your booking.
15.0 COMMUNICATION AND NOTICES
- All communications regarding your booking will be sent to the email address or phone number you provided.
- You are responsible for keeping your contact information up to date.
- Important notices may be sent via email, SMS, or through our Platform messaging system.
- Notices are deemed received 24 hours after sending.
16.0 REVIEWS AND FEEDBACK
- You may be invited to leave a review after your stay.
- Reviews must be honest, accurate, and respectful.
- We reserve the right to remove reviews that violate our content guidelines.
- Reviews become the property of our Platform and may be used for promotional purposes.
17.0 INTELLECTUAL PROPERTY
- All content on our Platform, including text, images, logos, and designs, is protected by copyright and trademark laws.
- You may not reproduce, distribute, or use any content without our written permission.
- Property photos and descriptions are the property of respective Property Owners.
18.0 LIMITATION OF LIABILITY
- Our Platform acts as an intermediary between Guests and Property Owners.
- Our total liability to you for any claims arising from your booking shall not exceed the total amount paid for your booking.
- We are not liable for indirect, incidental, or consequential damages.
19.0 INDEMNIFICATION
- You agree to indemnify and hold harmless our Platform, Property Owners, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your breach of these Terms and Conditions
- Your violation of any laws or regulations
- Your use of the property
- Any damage you cause to the property or third parties
20.0 SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21.0 ENTIRE AGREEMENT
- These Terms and Conditions, together with our Privacy Policy and any property-specific terms, constitute the entire agreement between you and our Platform regarding your booking.
- These terms supersede all prior agreements and understandings.
22.0 GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria.
You submit to the exclusive jurisdiction of the courts of Lagos State for any disputes arising from these terms or your booking.
